Terms of sale and use
These terms govern use of the service and orders for digital portraits.

1. Operator and scope
Halloweenize Me is operated by GVADEV SEMOU, Swiss sole proprietorship, Rue de Candolle 18, 1205 Geneva, Switzerland. Contact: [email protected]. These terms apply to the service and every order.
2. Service and product
The service uses artificial intelligence to create a personalized digital portrait from an eligible photograph. Examples are synthetic illustrations and do not promise a particular result. One digital file is supplied: 2K at 1856 × 2304 pixels or 4K at 3712 × 4608 pixels. No print or other physical product is included.
3. Adults and photo rights
The purchaser and every person depicted must be at least 18. You must own the photograph or have permission from its photographer or rights holder to upload and process it. Every identifiable person depicted must personally agree to the upload, AI processing, and delivery of the transformed image. Do not submit a photograph if age, consent, or image rights are uncertain.
4. Order and consent
Choose a style and resolution, upload a photograph, review the order summary, provide an email address, and complete payment at checkout. Before payment, you must separately accept the Terms and acknowledge the Privacy Policy, and expressly request immediate creation and delivery of the personalized digital portrait while acknowledging the possible loss of withdrawal rights when supply begins. We record the accepted wording, time, language, and legal version. The order confirmation email records these declarations on a durable medium.
5. Price and payment
The final price, including applicable taxes, is shown before payment. Payment is processed by Link (Stripe), which is shown as the seller at checkout, applies its own payment terms, issues the payment receipt, and handles transaction-level payment support. GVADEV SEMOU remains responsible for creating and delivering the portrait and for product support. Your bank may charge currency-conversion fees.
6. Delivery and availability
We email a download link when the portrait is ready and provide an order status page. No delivery delay is guaranteed. The link is valid for 30 days and permits a maximum of 3 downloads. After it expires or the file is deleted, the portrait cannot be recovered.
7. Licence
Subject to rights in the original photograph and the rights of each depicted person, you may use the delivered portrait for personal purposes, including public sharing, personal prints, gifts, invitations, and creator or influencer accounts even when monetised. The licence does not permit resale, merchandising, direct advertising, or promotion or sale of a product or service. No exclusive rights are assigned. We will not use a customer portrait for our marketing without separate, explicit permission.
8. Non-conformity and remedies
Contact [email protected] if the file is damaged, has the wrong resolution, contains a manifest defect, or is not delivered. Depending on the issue and applicable law, we will offer a correction, regeneration, or refund. No mandatory remedy is excluded. A simple change of mind after conforming delivery does not entitle you to a refund where applicable law allows this policy.
9. Switzerland
Swiss law provides no general statutory right to withdraw from an online purchase. Warranty rights and other mandatory rules continue to apply.
10. EU/EEA
For digital content not supplied on a tangible medium, the 14-day withdrawal right is lost once supply begins only if, before supply, you expressly consented to immediate performance, acknowledged the loss of that right, and received confirmation on a durable medium. These conditions correspond to the second declaration ticked before payment and to the order-confirmation email we send you (Directive 2011/83/EU, Articles 16(m) and 14(4)(b)). If supply has not started, the withdrawal right applies. The legal guarantee of conformity for digital content under Directive 2019/770 remains applicable.
11. United Kingdom
For digital content not supplied on a tangible medium, the withdrawal right can end when supply starts if you gave prior express consent, acknowledged the loss of that right, and received confirmation on a durable medium, under the Consumer Contracts Regulations 2013. The Consumer Rights Act 2015 remedies for digital content continue to apply.
12. United States
Rights may vary by state; nothing in these terms limits rights that cannot be waived under applicable law.
13. Mandatory rights and liability
Mandatory consumer rights always prevail. Each party remains responsible under applicable law. Nothing in these terms excludes liability that cannot lawfully be limited.
14. Personal data
We process personal data as described in the Privacy Policy, including the retention periods and request process set out there.
15. Changes and contact
The version of these terms accepted with an order applies to that order. Later changes do not alter an existing contract. Contact [email protected] with questions.
16. Governing law
These terms are governed by Swiss law. Subject to mandatory rules on jurisdiction and consumer protection that apply, the competent courts in Geneva, Switzerland, have jurisdiction over disputes. This clause does not deprive any consumer of mandatory protections or remedies guaranteed by applicable law.
